Short-Term Rental Agreement
This Short-Term Rental Agreement (the "Agreement") is between the owner of Wilche Cottage ("Host") and the person who books the property ("Guest"). By checking the acceptance box and completing payment at checkout, Guest confirms that Guest has read, understood, and agrees to this Agreement. Guest must be at least 25 years old to book and must be an occupant during the stay.
1. The property
Wilche Cottage is a one-bedroom, one-bathroom cottage in Road Town, Tortola, British Virgin Islands. It is a single-level home that comfortably sleeps a maximum of two guests, with self check-in by lockbox.
2. Reservation and payment
When you book, your payment card is authorized for the accommodation total and cleaning fee through Stripe, but it is not charged at that time. A reservation is a request to book until the Host confirms the dates. Your card is charged only when the Host confirms your reservation. If the Host does not confirm, or a reservation cannot be honored, the authorization is released and your card is not charged. For high-season or Emancipation Festival dates, the Host may confirm the final rate before charging.
3. Occupancy
The property is rented for a maximum of two guests. No additional overnight guests, visitors staying overnight, or unregistered occupants are permitted without the Host's prior written consent. The property may not be used for any commercial purpose, event, party, or gathering beyond the registered guests.
4. Check-in and check-out
Self check-in by lockbox is available between 4:00 PM and 9:00 PM on the day of arrival. Check-out is by 11:00 AM on the day of departure. Early check-in or late check-out may be available by prior arrangement with the Host. Remaining on the property past the agreed check-out time without authorization may result in an additional night's charge.
5. Cancellation and refunds
Cancellations are handled as follows, based on the date the Guest notifies the Host relative to the check-in date:
- 30 or more days before check-in: full refund of amounts paid, less any non-refundable payment processing fees.
- 7 to 29 days before check-in: 50 percent refund of the accommodation total.
- Fewer than 7 days before check-in, or no-show: no refund.
6. Damage and condition of the property
Guest agrees to leave the property in the same condition as found, allowing for normal wear. Guest is responsible for the cost of any loss or damage to the property, its furnishings, or its contents caused by Guest or any person Guest permits on the property, beyond normal wear. The Host may seek reimbursement from the Guest for such costs. No separate refundable security deposit is collected at the time of booking. Guest authorizes the Host to charge the payment method on file for the documented cost of any such loss or damage beyond normal wear. The Host relies on this clause and on Guest's payment method on file for any necessary recovery.
7. House rules
- No smoking or vaping anywhere on the property, indoors or outdoors.
- No pets.
- No parties, events, or commercial filming.
- Quiet hours are 10:00 PM to 8:00 AM. Please be considerate of neighbors.
- Do not exceed the maximum occupancy of two guests.
- Follow any posted instructions and applicable community or strata rules.
- No illegal activity of any kind is permitted on the property.
8. Security cameras
For the safety of guests and the property, exterior security cameras are present at the front door and in the backyard. There are no cameras inside the home. The exterior cameras are never used to monitor the interior or any private space.
9. Guest responsibilities
Guest agrees to lock the property when away, use the appliances and utilities responsibly, dispose of trash properly, and promptly report any maintenance issue, damage, or safety concern to the Host so it can be addressed.
10. Assumption of risk and limitation of liability
Guest and any person Guest permits on the property use the property and all of its amenities at their own risk. To the fullest extent permitted by law, the Host is not liable for any injury, illness, loss, or damage to persons or personal property arising from the use of the property, except to the extent caused by the Host's gross negligence or willful misconduct. Guest agrees to indemnify and hold the Host harmless from claims, damages, or expenses arising from Guest's stay or breach of this Agreement.
11. Access by the Host
The Host or the Host's representatives may enter the property to address an emergency, perform necessary repairs or maintenance, or inspect the property, with reasonable notice to the Guest except in the case of an emergency.
12. Events beyond control
Neither party is responsible for failure to perform due to events beyond reasonable control, including severe weather, hurricanes, natural disasters, utility failures, government action, or travel disruption. If the property cannot be occupied for such reasons, the Host will offer a refund of unused nights or, where possible, rescheduled dates.
13. Termination for breach
The Host may terminate this Agreement and require the Guest to leave the property without refund if the Guest exceeds the maximum occupancy, hosts a party or event, causes a disturbance, damages the property, or engages in illegal activity.
14. Governing law
This Agreement is governed by the laws of the British Virgin Islands, where the property is located. Any dispute relating to this Agreement or the stay will be subject to the courts of the British Virgin Islands.
15. Entire agreement
This Agreement is the entire agreement between the Host and the Guest regarding the stay and supersedes any prior understanding. If any provision is found unenforceable, the remaining provisions remain in effect. The Host may update these terms from time to time; the version in effect at the time of booking governs the stay.
16. Acceptance
By checking the box that says you agree to this Rental Agreement and completing payment, you acknowledge that you have read and agree to these terms. The date and time of your acceptance and the email used for the booking are recorded with your reservation.
